TERMS & CONDITIONS

Design Development 

These Terms and Conditions govern your access to and use of New Edge Studio’s website, products, and services. By accessing or using our services, you agree to be bound by these Terms, our Privacy Policy, and any other policies outlined below. Please read these Terms carefully and contact us if you have any questions.

1. Client Obligations
The client must:

Provide clear and complete documentation for the ‘Job Start Request’ and at all review stages.

​

Pay all invoices as per the agreed schedule. If no schedule is specified, payment is due within seven (7) days of receiving the invoice.

​

All payment claims are made under the Building and Construction Industry Security of Payment Act 2002.

​

Pay all fees (plus applicable GST) and disbursements as specified in this agreement, including any additional services or disbursements required thereafter. Interest applies to overdue accounts.

​

Understand that this fixed-price agreement is based on an expected volume of approximately two (2) jobs per month or more.

​

Note that urgent job requests may incur a $50 + GST daily surcharge per day earlier than the standard due date.

​

Provide clear mark-ups for all drawing revisions or amendments.

​

Engage specialist consultants directly and cover all associated costs.

​

Provide revision feedback within 48–72 hours. Delays beyond this timeframe may result in the job being placed on hold, requiring re-queuing which could take up to two (2) weeks depending on workload.

2. Architect/Draftsman Obligations
The Architect/Draftsman agrees to:

Deliver services with the competence and professionalism expected of a qualified practitioner.

​

Act as the client’s agent as needed for the project and in accordance with the selected building contract.

​

Coordinate all specialist consultants involved in the project.

​

Promptly notify the client in writing of any changes to the scope or additional services required.

​

Declare any potential conflicts of interest in writing and suspend services until resolved or the agreement is terminated.

Maintain registration with the relevant Architects or Drafting Registration Board in the project's jurisdiction.

3. Disclaimer
A Certified Land Surveyor must be engaged to obtain a land survey, re-establishment survey, and level data (approx. $2,500) prior to commencing the design stage.

​

Clients must provide property information from council and authorities. We can assist in obtaining this for $200 + GST plus disbursement costs.

​

Titles and property particulars were not available during feasibility studies and may affect project restrictions. These must be obtained before project commencement.

​

4. Planning Process Notice
A basic planning permit schedule is provided for reference. While we aim to meet all regulatory requirements, planning outcomes depend on council and public feedback. Objections or public dissatisfaction may impact council approval.

​

Council processing typically takes 6–8 months but varies.

​

No guarantees are made regarding approval outcomes.

​

5. Payment Options
Option A: Two-stage payment (50% at CD phase, 50% at CP phase)
Option B: Four-stage payment (Stages 1a, 1b, 2a, 2b)
Quotes valid for 30 days. Council, consultant, and authority fees not included.

​

6. Additional Fees
$220 per request beyond the two (2) concept design revisions.

$330 per request beyond one (1) preliminary drawing revision.

$400 for any major revision exceeding 4 hours of work.

$300 per 400mm of site fall requiring battering/retaining design.

$440 per request unrelated to the building surveyor regarding working drawings.

7. Timeframes
Jobs confirmed before 11:00 AM commence the same day; after 12:00 PM commence the next business day.

Allow 5 working days per stage; add 3 days for double-storey designs.

Allow 3 working days per revision; add 2 days for double-storey projects.

Timeframes may vary with project size or complexity. Delays caused by clients, consultants, or authorities may affect completion dates.

8. Unanticipated Services
While consultations are unlimited under the fixed-price agreement, tasks requiring extensive research or additional effort will be subject to a separate agreement and revised pricing prior to commencement.

​

9. Service Guarantee
Our work is guaranteed to the client's satisfaction. If unsatisfied, New Edge Studio will either redo the work or agree to a partial refund based on the level of satisfaction.

​

10. Review and Renewal
Terms may be reviewed quarterly or biannually. Unless otherwise stated, this agreement automatically renews annually if not amended within two (2) weeks of a scheduled review.

​

11. Termination
Either party may terminate the agreement with 14 days’ written notice. All outstanding fees must be paid within 14 days of termination. Grounds for termination include insolvency, breach of agreement, or failure to provide services with reasonable care.

12. Intellectual Property
Copyright:
New Edge Studio retains copyright over all design work. The client receives a revocable license for use solely on the intended project site. If any invoice is overdue, the license may be revoked and reinstated only upon payment.

​

Moral Rights:
New Edge Studio must be credited in any public dissemination of the design.

​

Distribution of CAD Files:

Our policy is not to share the CAD file with clients as stated in our terms and conditions (see below).
NES retains the rights to all tools used to create the design for your project. This includes the CAD files which are copyrighted instruments of service and will not be distributed to the clients unless stipulated in any terms of engagement with the client.  
CAD files are part of NES’ Intellectual Property, and it is in our best interest to protect our assets from potential liability issues that may arise from giving clients access to files of an editable nature. 
 
If our CAD file is required by external consultants for the purposes of engineering or other construction requirements, a written request to NES will be required with CAD file sent directly to the external consultant at NES discretion.

13. Electronic Data Transfer
The client agrees that:

Data may be issued electronically to all project participants.

New Edge Studio is not liable for errors or contamination in transmitted data.

Preparation and conversion costs for electronic data are billable.

​

14. Limitation of Liability
To the extent permitted by law, New Edge Studio is not liable for any direct or indirect damages arising from use of its website or services, including data loss, system interruption, or third-party conduct.

​

15. Privacy Policy
We comply with Australian privacy laws. Personal data is collected only for necessary purposes and shared internally or with agents as required. Data will not be disclosed without consent, unless required by law. You have the right to access or correct your personal information.

​

16. Payment Terms and Conditions
Consultant and authority fees must be paid in advance. Quotes may vary depending on external factors.

Three (3) client consultations are included. Additional consultations charged at $110/hour.

Additional printed copies of drawings will incur charges per page size.

Major alterations due to planning outcomes will be billed at $110/hour.

Invoices are due within five (5) business days of receipt and before release of documentation. No credit provided.

17. Dispute Resolution
Any disputes must be addressed through direct discussion at least once before pursuing legal action.

​

18. Amendments
These Terms may be updated due to changes in law or services. Clients will be notified of any material updates at least 30 days in advance.
